SPIRAL PRIVACY POLICYEffective Date: October 8, 2026Spiral is operated by Eternal444 LLC (“Eternal,” “we,” “us,” or “our”). This Privacy Policy explains how information is handled when you use the Spiral mobile application (“Spiral” or the “App”) and visit our associated website (collectively, the “Services”).1. THE SHORT VERSIONSpiral is designed to help you work through thoughts, worries, decisions, and situations by turning what you submit into a structured reflection.To do that, the content you submit to Spiral must be processed by the services that power the App, including our backend infrastructure and artificial intelligence service providers.We do not sell your personal information, and we do not use the thoughts you submit to Spiral for advertising.Spiral does not currently require you to create an account.Our website provides information about Spiral, access to support and legal information, and links to the App and our social media presence.2. INFORMATION YOU PROVIDEWhen you use Spiral, you may choose to provide information such as:- The thoughts, situations, questions, or concerns you enter into Spiral;
- Responses you provide while using features such as Still Spiraling or Deeper Focus;
- Information submitted when requesting a personalized action plan;
- Content necessary to generate narration or other features you choose to use; and
- Information you voluntarily provide when contacting us for support.As Spiral evolves, additional optional features may process information you choose to provide or information from your saved Spiral activity.Because Spiral is a reflection tool, what you choose to enter may sometimes be personal or sensitive. You control what you choose to submit.Please avoid entering information about another person that you do not have the right to provide.3. HOW YOUR CONTENT IS PROCESSEDWhen you request a Reality Check or use certain other Spiral features, the information necessary to fulfill that request is transmitted securely to Spiral's backend infrastructure for processing.Spiral uses services provided by Supabase for backend infrastructure and OpenAI for artificial intelligence functionality. Information you submit may therefore be transmitted to and processed by these providers when necessary to provide the feature you requested.For example, processing may be necessary to:- Generate a Reality Check;
- Respond when you use Still Spiraling or Deeper Focus;
- Create a personalized action plan;
- Generate narration; or
- Provide additional personalized reflection features as they become available.OpenAI does not use data submitted through its API to train its models by default unless the API customer affirmatively opts in to data sharing. OpenAI may retain certain API data for limited periods for purposes such as abuse monitoring, security, and legal compliance, subject to its applicable policies and the configuration of the services we use.We use service providers to operate Spiral. Their handling of information is also subject to the applicable agreements and privacy practices governing those services.4. INFORMATION STORED ON YOUR DEVICESpiral stores certain information locally on your device so the App can function and preserve your experience.Depending on how you use Spiral, this may include:- Saved Spiral content and session information;
- App preferences and settings;
- Usage or allowance information;
- Subscription-related state;
- Cached narration files;
- Profile or onboarding preferences; and
- A device-specific installation identifier stored using Apple's Keychain technology.The installation identifier helps Spiral distinguish an installation of the App and support functionality such as security and usage management. It is not intended to identify you by your real-world identity.Some information may also be processed or maintained by our backend infrastructure where necessary for the operation, security, or functionality of the Services.5. SUBSCRIPTIONS AND PAYMENTSPaid Spiral subscriptions are purchased and managed through Apple's App Store and StoreKit systems.Apple processes your payment transaction. Eternal444 LLC does not receive your complete payment-card information from Apple.We may receive information necessary to determine your subscription status, such as whether a subscription is active and which Spiral plan applies to you.Subscription-related information may also be processed to manage usage allowances, verify entitlements, prevent misuse, and provide access to purchased features.6. PHOTO LIBRARY ACCESS AND SHARINGCertain optional features, when available, may allow you to save or share content generated through Spiral.If you choose to save a Spiral image or share card to your photo library, Spiral may request permission to add that image to your Photos library.Spiral does not require general access to your personal photo library simply to use its core reflection features.When you choose to share content through your device's sharing options, that content may be handled by the applications or services you select. Their handling of the shared information is governed by their own privacy practices.7. WEBSITE INFORMATIONWhen you visit the Spiral website, certain technical information may be processed by the website hosting provider as part of delivering, maintaining, and securing the website.Depending on the provider and configuration, this may include information such as your IP address, browser type, device information, and basic request or access logs.The website may contain links to external services, including Apple's App Store and Instagram. When you follow these links, the destination service's own privacy practices apply.We do not use the thoughts you submit within Spiral to target advertising on the website.If we introduce additional website features, analytics, or tracking technologies, we will update this Privacy Policy and provide any disclosures or choices required by applicable law.8. ANALYTICS, ADVERTISING, AND TRACKINGSpiral does not currently use a third-party advertising network or third-party analytics SDK within the App.We do not use the thoughts you submit to Spiral to serve you targeted advertisements.We do not sell your personal information.Technical information may be processed by our infrastructure and service providers for purposes such as security, troubleshooting, service delivery, and preventing misuse.If we materially change our analytics or tracking practices in the future, we will update this Privacy Policy and make any disclosures or obtain any permissions required by applicable law or platform rules.9. SECURITYWe use technical and organizational measures designed to protect information processed through Spiral. These include encrypted network connections and security measures within the App and its backend infrastructure.We may use technical identifiers, verification mechanisms, and other security measures to help protect the Services against unauthorized access, abuse, and misuse.No method of electronic transmission or storage can be guaranteed to be completely secure, however, and we cannot promise absolute security.10. DATA CONTROLS AND DELETIONSpiral provides controls for deleting saved Spiral content and resetting certain locally stored App data.Deleting content from your device does not necessarily delete information that has already been transmitted to or retained by backend infrastructure or service providers.Some technical information used for security or installation integrity, such as a device-specific installation identifier stored in Apple's Keychain, may not be removed by an ordinary in-app data reset.You may contact us at [email protected] with privacy or data-related questions, including requests concerning information we may maintain through our Services.We will review applicable requests and respond in accordance with relevant legal requirements and the technical capabilities of the Services.As Spiral's backend and security architecture evolves, we may provide additional controls for information maintained by our services.11. DATA RETENTIONLocally stored information remains on your device according to the operation of the App and the controls available to you.Information processed or maintained by our backend infrastructure and service providers may be retained as necessary to provide, maintain, secure, and improve the operation of the Services, subject to applicable service-provider arrangements and legal requirements.Retention may vary depending on the type of information, the purpose for which it is processed, and applicable technical or legal requirements.We do not promise a specific retention period where we cannot accurately control or guarantee one.12. CHILDREN'S PRIVACYSpiral is not directed to children under 13, and we do not knowingly collect personal information from children under 13.If you believe a child under 13 has provided personal information through Spiral, please contact us at [email protected].Additional age restrictions may apply depending on your location or the requirements of the App Store.13. INTERNATIONAL PROCESSINGThe services used to operate Spiral may process information in locations different from where you live.Information may therefore be processed in jurisdictions with different data-protection laws, subject to applicable legal requirements and service-provider safeguards.15. CHANGES TO THIS PRIVACY POLICYWe may update this Privacy Policy as Spiral evolves, including when we add or change features, service providers, website functionality, or data practices.When we make material changes, we will update the effective date and provide any additional notice required by applicable law.Your continued use of the Services after an updated policy becomes effective does not override any consent or other rights provided by applicable law.16. If you do not agree, do not use our services.1. WHAT SPIRAL ISSpiral is an AI-powered reflection tool designed to help you examine thoughts, situations, assumptions, possibilities, and potential next steps.You can describe what is on your mind and use features such as Reality Check, Still Spiraling, Deeper Focus, personalized action plans, and narration to explore it in a more structured way.Spiral is designed for reflection and informational purposes.2. SPIRAL IS NOT PROFESSIONAL CARESpiral is not a therapist, physician, psychologist, counselor, medical provider, mental-health professional, legal adviser, financial adviser, or emergency service.Nothing provided through Spiral constitutes medical, mental-health, legal, financial, or other professional advice, diagnosis, or treatment.You are responsible for deciding whether and how to act on information generated through Spiral.Where appropriate, seek guidance from a qualified professional.3. EMERGENCIES AND CRISIS SITUATIONSSpiral is not designed to monitor emergencies or provide crisis intervention.Do not rely on Spiral if you believe you or another person may be in immediate danger or require urgent professional assistance.In an emergency, contact the appropriate emergency services or crisis resources available in your location.4. AI-GENERATED CONTENTSpiral uses artificial intelligence to generate personalized reflections and other content based on information you provide.AI-generated content can be incomplete, inaccurate, unexpected, or inappropriate for a particular situation. Spiral may misunderstand information you provide or generate a response that does not reflect the full context of your circumstances.You should use your own judgment when considering Spiral’s responses.Spiral does not guarantee that any generated interpretation, possibility, suggestion, action step, or narration is accurate, complete, or appropriate for you.5. YOUR CONTENTYou retain ownership of the content you submit to Spiral.By submitting content, you authorize Eternal and the service providers necessary to operate Spiral to process that content for the purpose of providing, maintaining, securing, and improving the functionality you request, subject to our Privacy Policy.You represent that you have the right to submit the content you provide.Do not submit information about another person if you do not have the right to provide it.6. PRIVACYYour use of Spiral is also governed by the Spiral Privacy Policy.The Privacy Policy explains how information is processed, stored, and handled when you use Spiral, including the role of service providers used to power its backend and AI functionality.7. FREE USESpiral currently includes two complimentary Spirals provided as a one-time introductory allowance per eligible installation, rather than a recurring monthly allowance.Complimentary Spirals do not renew or roll over.Associated features included within a Spiral may be governed by the App's current usage rules.Reinstalling the App, resetting local data, or otherwise modifying an installation does not guarantee that additional complimentary Spirals will become available.Eternal may modify the availability or structure of complimentary usage in future versions of Spiral, subject to applicable law and platform requirements.8. PAID SUBSCRIPTIONSSpiral currently offers monthly auto-renewable subscription options.The available plans are:Spiral 10 — $0.99/monthUp to 10 Spirals during each paid subscription period.Spiral 30 — $2.99/monthUp to 30 Spirals during each paid subscription period, including narration.Spiral Unlimited — $4.99/monthUnlimited customer-facing Spiral usage during the subscription period, including narration, subject to reasonable technical, security, and abuse-prevention measures.Actual prices are displayed through Apple's purchase system and may vary by country, currency, taxes, or changes made through the App Store.The price displayed by Apple at the time you subscribe is the price applicable to your purchase.Apple's purchase interface and App Store information control if there is a discrepancy between a price stated in these Terms and the price presented to you by Apple.9. RENEWAL AND BILLINGPaid Spiral subscriptions are billed through your Apple Account.Subscriptions automatically renew at the end of each subscription period unless canceled in accordance with Apple's subscription rules.Your Apple Account will be charged according to the price and terms displayed during purchase.Eternal does not directly process your payment-card information for App Store subscriptions.Apple's applicable billing, refund, renewal, and payment policies also apply to purchases made through the App Store.10. CANCELLATIONYou may manage or cancel your Spiral subscription through your Apple Account subscription settings.Deleting Spiral from your device does not automatically cancel an active subscription.Cancellation generally prevents future renewal; access to paid features may continue through the remainder of the already-paid subscription period in accordance with Apple's rules.11. RESTORING PURCHASESSpiral provides a Restore Purchases option for eligible App Store purchases.You may use this feature when appropriate to restore access associated with your Apple Account.12. UPGRADES AND DOWNGRADESIf you change between Spiral subscription tiers, the timing and billing treatment of that change may be determined by Apple's subscription system.Spiral may preserve usage already consumed during the applicable subscription period when changing plans.The App will apply the functionality associated with the subscription status reported by Apple.13. USAGE ALLOWANCESUsage allowances associated with paid plans apply to the relevant subscription period and do not roll over unless Spiral expressly states otherwise.A Spiral generally refers to the initial Reality Check generated from an entry together with the associated reflection experience defined by the App.Reasonable technical limits, security controls, or abuse-prevention measures may apply even to plans described to customers as “Unlimited.” These measures are intended to protect the availability, security, and integrity of the service rather than establish an ordinary customer-facing usage allowance.14. NARRATIONNarration is available on supported subscription plans.Narrated content is generated from Spiral content and may be cached locally on your device to support playback.Availability of voices, narration technology, or narration features may change over time.15. AVAILABILITY OF SPIRALWe work to keep Spiral available and functioning, but we do not guarantee uninterrupted or error-free operation.Features may temporarily become unavailable because of maintenance, network conditions, third-party services, technical failures, security concerns, or circumstances outside our control.We may modify, improve, replace, add, or remove features as Spiral evolves.16. ACCEPTABLE USEYou may not use Spiral to:- Violate applicable law;
- Infringe another person's rights;
- Attempt to gain unauthorized access to Spiral or its infrastructure;
- Circumvent usage limits, subscriptions, security systems, or technical restrictions;
- Interfere with or disrupt Spiral's operation;
- Reverse engineer or exploit the service except where applicable law expressly permits it;
- Use automated systems to abuse or place unreasonable demands on the service; or
- Submit content that you do not have the right to provide.We may take reasonable steps to protect Spiral and its users from fraud, abuse, security threats, or misuse.17. INTELLECTUAL PROPERTYSpiral, including its software, design, branding, interface, visual elements, original written material, and other proprietary content, is owned by or licensed to Eternal444 LLC and is protected by applicable intellectual-property laws.These Terms give you a personal, limited, non-exclusive, non-transferable right to use Spiral for its intended purpose. They do not transfer ownership of Spiral or Eternal's intellectual property to you.Your own submitted content remains yours as described above.18. THIRD-PARTY SERVICESSpiral relies on third-party technologies and services to provide certain functionality.Those services may have their own terms, policies, availability, and technical limitations.Eternal is not responsible for outages or changes to third-party services outside our reasonable control, although we will work to maintain Spiral's functionality where reasonably possible.The Spiral website may also contain links to third-party websites or services, including Apple's App Store and Instagram. Those services are governed by their own terms and policies.19. DISCLAIMER OF WARRANTIESTo the extent permitted by applicable law, Spiral is provided on an “as is” and “as available” basis.We do not guarantee that Spiral will always be available, error-free, completely secure, or that AI-generated content will be accurate or suitable for every circumstance.Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.20. LIMITATION OF LIABILITYTo the fullest extent permitted by applicable law, Eternal444 LLC and its owners, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Spiral.Nothing in these Terms limits liability that cannot legally be limited or excluded.Your rights may vary depending on where you live.21. SUSPENSION OR TERMINATIONWe may restrict or terminate access to Spiral where reasonably necessary because of fraud, abuse, security threats, violation of these Terms, legal requirements, or conduct that threatens Spiral or its users.You may stop using Spiral at any time.Stopping use of the App or deleting it does not itself cancel an active App Store subscription.22. CHANGES TO SPIRAL OR THESE TERMSSpiral will evolve over time.We may update these Terms to reflect changes to the App, subscriptions, technology, legal requirements, or business practices.When material changes are made, we will update the effective date and provide additional notice where required.Continued use after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.23. GOVERNING LAWThese Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles, except where applicable consumer-protection law requires otherwise.Nothing in these Terms deprives you of mandatory consumer rights available under the laws applicable to you.24.
